Epic Games, which has been sued by Silicon Knights, isn't very happy. VP Mark Rein said that his company has done nothing wrong and Epic has now filed a counterclaim against Silicon Knights stating that SK has misappropriated Epic's technology and won't pay. More within...

Epic Games' VP Mark Rein today sent select members of the media, including GameDaily BIZ, and update on the company's legal battle with developer Silicon Knights. Silicon Knights' President Denis Dyack believes that Epic kept a usable version of the Unreal Engine to itself for Gears of War development and provided Silicon Knights (SK) with the kit far too late. SK alleges that Epic harmed development of Too Human, as well as other Epic licensees.
Rein, however, insists that Epic has "done nothing wrong." He added, "We continue to be committed to fully defending against Silicon Knights' unfounded allegations."

Epic has filed a counterclaim in the U.S. District Court for the Eastern District of North Carolina, which states that SK "decided to misappropriate Epic's licensed technology" and that their lawsuit "lacks factual or legal merit."

"Indeed, the plain language of the Silicon Knights' Complaint makes clear that Silicon Knights wants to take Epic's Licensed Technology, pay nothing for it, and use it any way it pleases," Epic said.

In the counterclaim, Epic outlined that it's "setting forth claims for copyright infringement, breach of contract, misappropriation of trade secrets, and for the imposition of a constructive trust, results from Silicon Knights' wrongful conduct, which is continuing... Epic seeks injunctive relief, compensatory and punitive damages, the destruction of infringing goods, including infringing computer code, and attorney's fees and costs."

Das wird noch richtig spannend; leider haben wir nicht so wirklich den Einblick in die Sache was da wirklich vorgefallen ist. Das Ergebnis werden wir ja irgendwann mal sehen, aufjedenfall wird das teuer. 8-)

ne das ist kein gerücht sondern eine offizielle Aussage von Marc Rein^^
 
naja, ich seh schon ein das es wohl ein fakt ist ...
aber cw is ja nich dein geliebtes gaf ... die deutschen sind da wohl etwas entspannter wenn es um solche "detailprobleme" geht ;)

Silicon Knights Responds: Epic Counterclaim Has No Merit; Too Human Development on Track GameDaily BIZ has been in contact with Silicon Knights' attorney, Chris Holland, who informed us that Silicon Knights will stand its ground. Holland says the counterclaim from Epic is completely without merit and development on Too Human has not been affected. In fact, SK has created a "better" engine for the game as a result.

Following Mark Rein's new statement and Epic Games' counterclaim GameDaily BIZ spoke with Silicon Knights' attorney, Christopher T. Holland, an Equity Partner at Krieg, Keller, Sloan, Reilley & Roman. Unsurprisingly, Silicon Knights stands firm in its belief that Epic is at fault.
"We don't think Epic's counterclaim has any merit," Holland told us. "We believe strongly that our claims in our complaint will prevail and the damages Silicon Knights has suffered in connection with its original complaint are vastly more, millions of dollars more than what Epic claims its damages are in its counterclaim. They've set forth $650,000 and our claims will dwarf that substantially."

As an exclusive Xbox 360 trilogy, Too Human obviously means a lot to Silicon Knights (SK). It's a project that's been in development for many years, and if you ask SK they'll tell you that they're going to make a great game despite the hurdle they've faced with Epic and the Unreal Engine.

"The lawsuit itself will not have any effect on Too Human," Holland insisted. "The lawsuit is based on substantial delay and damage that Epic caused us, but through our own sweat and toil, we have created a new and better game engine, in our view, that we're utilizing now. We basically had to do ourselves what we paid Epic to do. As a result, we are back on track and this game is going to come out in a timely fashion."

Holland couldn't confirm whether the game would make it to market this year; he said it's up to SK and publisher Microsoft to determine that. One thing we do know is that Too Human was nowhere to be seen at this year's E3. However, SK President Denis Dyack told GameDaily BIZ previously that the game was a no-show because SK has "another event planned in the future for Too Human that we thought would be more appropriate" and SK was "extremely busy finalizing the game and we simply could not spare the time."

Finally, we asked Holland about Epic's claim that this new "Silicon Knights Engine" is essentially stealing code from the Unreal Engine. Holland simply pointed us in the direction of his first comment to us: Epic's counterclaim has no merit.

Dieses "Du bist doof" "Nein du viel doofer" "Nee du" wird ja immer schlimmer...
Noch dazu hat der Thread hier relativ wenig bis gar nichts mit War zu tun. Sowas würde in den Games allgemein viel besser passen...
 
ich habe mich mit dem ganzen streit gar nicht ausseinander gesetzt, worum gehts da überhaupt? bitcht CliffyB rum oder sind die Knights zu doof für die Unreal Engie 3?

ich finde ihn absolut unsymphatisch. hat er nicht gleich mal zu wii-launch zeiten das ding als nutzloses spielzeug abgetan?

von sk hab ich bis jetzt noch garnichts negative gehört.
